These Terms of Service ("Terms") govern your use of the StreakParty mobile app, web app, and website (together, the "Service"), operated by StreakParty ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use StreakParty
You must be at least 13 years old (or the higher minimum age required in your country) to use the Service. You must provide accurate account information and keep your login credentials secure. You are responsible for all activity that happens under your account.
2. Your content
StreakParty lets you post content: streak names and descriptions, check-in photos, profile details, and messages ("Your Content"). You keep ownership of Your Content. By posting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, and transmit Your Content solely as needed to operate and improve the Service — for example, showing your check-in photo to your streak's members.
You are responsible for Your Content. You must have the rights to anything you post, and you must not post content that includes other people's personal information without their consent.
3. Acceptable use
You agree not to:
- Post content that is illegal, threatening, harassing, hateful, sexually explicit, or that exploits or endangers minors;
- Impersonate any person or misrepresent your affiliation with anyone;
- Spam, scam, or send unsolicited promotions through streaks or messages;
- Attempt to access other users' accounts or data, probe or disrupt the Service, or bypass security or rate limits;
- Scrape, harvest, or bulk-collect data from the Service;
- Use the Service to violate any applicable law.
We have zero tolerance for objectionable content and abusive users. We may remove content or suspend or terminate accounts that violate these Terms — without notice where the violation is serious — and we may report unlawful activity to the relevant authorities. Content reported by users is reviewed within 24 hours; content that violates these Terms is removed and the offending user may be ejected from the Service.
4. Streaks, leaderboards, and achievements
Streak counts, leaderboards, and achievement badges are provided for motivation and fun. They have no monetary value, cannot be sold or transferred, and may be recalculated, changed, or reset if we detect errors or abuse (for example, falsified check-ins).
5. Other users
Content in streaks, chats, and profiles is created by users, not by us. We do not endorse user content and are not responsible for it, though we moderate and remove content that violates these Terms. The app includes tools to report any message, photo, or user (long-press a message, or use the ⋯ menu on a profile) and to block any user (blocked users cannot message you or send you friend requests; manage your list under Profile → Settings → Blocked users). Reports are reviewed within 24 hours. You can also contact Support to report abuse.
6. The Service is provided "as is"
We work hard to keep StreakParty running, but the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that data (including streak history) will never be lost. Nothing in these Terms excludes guarantees that cannot be excluded under applicable law, including the Australian Consumer Law.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of the Service. To the extent liability cannot be excluded, our total liability for all claims relating to the Service is limited to the greater of AUD $50 or the amount you paid us in the 12 months before the claim arose.
8. StreakParty is not health advice
StreakParty helps you track habits you choose. It is not medical, fitness, or health advice. Consult a qualified professional before starting any exercise, diet, or health program, and use your own judgment about what habits are right for you.
9. Termination
You can stop using the Service and delete your account at any time (Profile → Settings → Delete account, or see how to request deletion). We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including licences needed to wind down, disclaimers, and limitations of liability) survive.
10. Intellectual property
The Service — including the StreakParty name, logo, design, and software — is owned by us or our licensors and is protected by intellectual-property laws. Apart from Your Content, we grant you only a personal, non-transferable, revocable licence to use the app and website as intended. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service except as permitted by law.
11. Changes to the Service and these Terms
We may add, change, or remove features over time. We may also update these Terms; if we make material changes we will notify you in the app or by email before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Australia. Courts located in Australia have exclusive jurisdiction over disputes arising from these Terms or the Service, except where the law of your country of residence gives you the right to bring proceedings locally.
